As used in this Policy, the term: (a) “Affiliate” means, as to any person or entity, any other person or entity that, directly or indirectly, is in Control of, is Controlled by or is under common Control with such person or entity; (b) “Control” means the possession, directly or indirectly, of the power to direct or cause the direction of the management, policies or activities of the person or entity in question, whether through ownership of voting securities, by contract or otherwise; (c) “WestPoint Home Parties” means WestPoint Home and all of its Affiliates; and (d) “Personal Information” means any combination of information, in the possession of or likely to come into the possession of a WestPoint Home Party that can be used to identify, contact, or locate a discrete individual. For purposes of clarification, any information which cannot be used to identify a discrete individual (such as aggregated statistical information) is not Personal Information.
What personally identifiable information does WestPoint Home collect?
The information gathered and/or generated by the WestPoint Home Parties about you falls into two categories: (1) information voluntarily supplied by visitors to a Site; and (2) tracking information gathered as you navigate through the Website.
Information Collected Directly
WestPoint Home collects personal information that you provide when using the Website. This personal information is gathered when you register on the Website or make a purchase on the Website. When you register on the Website, you provide us with your email address and a unique password. When you make a purchase on the Website, we collect your name, address, phone number, email address and other personal information necessary to fulfill, track and bill your order. In order to bill you for your purchase we also collect credit card information including your card type, credit card number, and expiration date. We also collect shipping address information that allows us to ship your order. This includes the name, address and phone number of the intended recipient.
When you register and checkout, we save your shipping and billing address information. You may elect to have us save your credit card information to expedite future purchases. If you so elect, we save your card type, credit card number, expiration date, and name on the card. You may checkout as a guest if you don’t want us to save your shipping, billing or credit card information.
You may change saved shipping or billing information at any time. Simply go to the My Account page, login with your email address and password, follow the appropriate links and edit or delete whatever personal information you wish.
There are a few other instances when WestPoint Home may collect other personal information from you. For example, if you contact our Customer Service department, we may store your email address or phone number in order to respond to your questions or requests for assistance. WestPoint Home reserves the right to keep a record of any communication between you and WestPoint Home.
Website Navigational Information
As you navigate a Site, we may also collect information through the use of commonly-used information-gathering tools, such as cookies and web beacons (collectively “Website Navigational Information”). Website Navigational Information includes standard information from your web browser (such as browser type and browser language), your Internet Protocol (“IP”) address, and the actions you take on a Site (such as the web pages viewed and the links clicked).

Also, if a WestPoint Home Party itself or substantially all of a WestPoint Home Party’s assets were acquired, your Personal Information may be one of the transferred assets. We reserve the right to disclose, without your prior permission, any Personal Information about you or your use of the Website if the WestPoint Homes Party has a good faith belief that such action is necessary to: (a) protect and defend the rights, property or safety of a WestPoint Homes Party, WestPoint Homes’ employees, other users of the Website, or the public; (b) enforce the terms and conditions that apply to use of the Website; (c) as required by a legally valid request from a competent governmental authority; or (d) respond to claims that any content violates the rights of third-parties. We may also disclose Personal Information as we deem necessary to satisfy any applicable law, regulation, legal process, or governmental request.
How can I control the collection, usage and distribution of any personal information I provide to the Site?
WestPoint Home understands and values the importance of giving you, the customer, control over your personal information.
If you are a registered customer on the Website, we will store the information you provide for a quick and easy checkout process every time you place an order with us. However, if you want to make a purchase, but do not want to register with the Website, you can do so without the Website having access to your information. During this “Checkout as a Guest” process, you will still be asked for your name, shipping address, billing address, phone number, email and credit card number. Once you have made your purchase, we will send you an email confirming your order and a shipping notification email that includes a tracking number for your reference. The information you provide during the Guest Checkout process will be used to process your order consistent with this Policy. Unless you elect to register for an account, you will have to re-enter your information each time you make a purchase.

Finally, your personal information is protected by the password you created when you signed up for an account at the Website. You may change this password anytime by accessing the My Account section of the Website. Please keep this password confidential. No representative of WestPoint Home, including our Customer Service representatives, will ever ask you for your password.
We do not knowingly collect any personal information from anyone who we know to be under the age of 13. If you are under the age of 13, you should use our Website only with the permission of a parent or guardian and should not submit any personal information to us. If a parent or guardian becomes aware that a child under the age of 13 has submitted personal information on our Website, please contact us and we will remove the personal information about the individual from our database.
